سندھ میں بلدیاتی ادارے تحلیل کرکے تمام ناظمین کی جگہ سرکاری ایڈمنسٹریٹرز تعینات کرنے اور 4 ماہ کے اندر جماعتی بنیادوں پر بلدیاتی انتخابات کرانے کی منظوری

کراچی،   سندھ اسمبلی نے بلدیاتی نظام میں ترامیم سے متعلق ترمیمی بل 2010ءمتفقہ طور پر منظور کر لیا ہے، سندھ میں بلدیاتی ادارے تحلیل کرکے تمام ناظمین کی جگہ سرکاری ایڈمنسٹریٹرز تعینات کرنے کے علاوہ 4 ماہ کے اندر جماعتی بنیادوں پر بلدیاتی انتخابات کرانے کی منظوری بھی دے دی گئی ہے، بل کی منظوری کے بعد گورنر سندھ کے دستخط کے بعد سندھ حکومت کے نوٹیفکیشن سے تمام بلدیاتی ادارے تحلیل کرکے شہری ناظم، ضلعی ناطمین، تحصیل اور ٹاﺅن ناظمین، یوسیز ناظمین کو ہٹاکر سرکاری افسران کو ایڈمنسٹریٹرز تعینات کیا جائے گا، سندھ حکومت کو بل کی منظوری کے بعد ناظمین کی جگہ سرکاری افسران کو ایڈمنسٹریٹرز تعینات کرنے کے اختیارات مل گئے۔

پیر کے روز سندھ اسمبلی کا اجلاس اسپیکر نثار احمد کھوڑو کی صدارت میں ہوا۔ اجلاس میں تلاوت کلام پاک، نعت خوانی، فاتحہ خوانی اور وقفہ سوالات کے بعد صوبائی وزیر بلدیات آغا سراج درانی نے بلدیاتی نظام 2001ءمیں ترامیم کرنے کے سندھ بلدیاتی نظام ترمیمی بل 2010ءایوان میں منظوری کے لئے پیش کرتے ہوئے کہا کہ بلدیاتی نظام کی 4 سالہ مدت پوری ہو چکی ہے اس لئے نظام میں ترامیم کرکے ناظمین کی جگہ ایڈمنسٹریٹرز کو مقرر کیا جائے تاکہ 4 ماہ کے اندر شفاف طریقے سے جماعتی بنیادوں پر انتخابات کرائے جائیں۔ انہوں نے کہا کہ پہلے وفاق چاروں صوبوں کو کنٹرول کرتا تھا اور صدر نے بلدیاتی اختیار صوبوں کو منتقل کر کے جرا¿ت کا مظاہرہ کیا ہے۔ انہوں نے کہا کہ جو لوگ یہ چاہ رہے تھے کہ یہ بل پیش نہ ہو اور ڈکٹیٹر شپ کا نظام چلتا رہے مگر وہ کامیاب نہیں ہوئے۔

انہوں نے کہا کہ اس بل کے بعد ایڈمنسٹریٹرز مقرر کرکے 120 دن میں بلدیاتی انتخابات جماعتی بنیادوں پر کرائیں گے اور انتخابات کی تیاری کے لئے پورے صوبے کو دعوت دیتا ہوں کہ وہ انتخابات میں حصہ لیں۔ انہوں نے کہا کہ بلدیاتی انتخابات میں عوام ایک اور خوشخبری سنے گی جس کے بعد ایوان نے سندھ بلدیاتی نظام ترمیمی بل 2010ءکو بحث کے بعد متفقہ طور پر منظور کر لیا۔ بل کے تحت لوکل گورنمنٹ آرڈیننس کی شق نمبر 153 میں ترمیم کی گئی ہے جس کے تحت اب بلدیاتی انتخابات جماعتی بنیادوں پر 4 ماہ میں کرائے جائیں گے اور آزاد امیدوار بھی بلدیاتی انتخابات میں حصہ لے سکیں گے۔ لوکل گورنمنٹ آرڈیننس کی شق نمبر 179 میں ترمیم کی گئی ہے جس کے تحت شہری، ضلعی حکومتوں، تحصیل اور ٹا ن میونسپل ایڈمنسٹریشن، یونین ایڈمنسٹریشن، ضلعی کونسلز، تحصیل اور ٹا ن کونسلز اور یونین کونسلز اس تاریخ سے تحلیل ہو جائیں گی جس تاریخ سے سندھ حکومت نوٹیفکیشن جاری کرے گی جس کے بعد شہری، ضلعی، تحصیل، ٹا نز ناظمین، یوسیز ناظمین، نائب ناظمین، کونسلرز اپنے دفاتر اور اختیارات استعمال نہیں کر سکیں گے۔

سندھ حکومت کے نوٹیفکیشن کے بعد ناظمین کو ہٹائے جاتے ہی سرکاری افسران کو ایڈمنسٹریٹرز مقرر کیا جائے گا جو اس وقت تک اپنے اختیارات استعمال کر سکیں گے اور کام چلاتے رہیں گے جب تک نئے ناظمین منتخب ہو کر آئیں۔ بل کے تحت ایڈمنسٹریٹرز وقتاً فوقتاً سندھ حکومت سے ملنے والی ہدایات، کاموں اور اختیارات کے تحت اپنے فرائض انجام دیں گے۔ بل کے تحت بلدیاتی اداروں کے تحلیل ہونے کے بعد ایک ماہ کے اندر سندھ حکومت چیف الیکشن کمشنر کو بلدیاتی اداروں کے انتخابات کرانے کی سفارش کرے گی جو کہ ایڈمنسٹریٹرز کی تقرری کی تاریخ کے بعد 4 ماہ میں کرائے جائیں گے۔ بل کے تحت بلدیاتی انتخابات 4 ماہ میں جماعتی بنیادوں پر کرائے جائیں گے اور ایڈمنسٹریٹرز سرکاری افسران ہوں گے۔ بل کے تحت 4 ماہ کے عرصے میں بلدیاتی نظام میں مزید قانون سازی نہیں کی گئی تو اس ترمیمی بل کے تحت ہی بلدیاتی انتخابات کرائے جائیں گے۔ قانونی ترمیمی بل 2010ءکا لوکل گورنمنٹ ترمیمی قانون کہلائے گا اور یہ قانون سندھ بھر میں فوری نافذ العمل ہو گا۔

بل پر بحث کرتے ہوئے صوبائی وزیر سید مراد علی شاہ نے کہا کہ موجودہ ناظمین کی نگرانی میں شفاف انتخابات نہیں ہو سکتے اور ہم شفاف انتخابات کرانا چاہتے ہیں اس لئے ناظمین کی جگہ ایڈمنسٹریٹرز ضروری ہیں۔ انہوں نے کہا کہ 120 دن کے اندر بلدیاتی انتخابات کرائے جائیں گے۔ انہوں نے کہا کہ یہ بلدیاتی نظام ایک ڈکٹیٹر لایا انہوں نے سندھ اسمبلی کو اس قابل نہیں سمجھا کہ اس بل پر اسمبلی میں بحث ہو اور ترامیم ہو مگر موجودہ حکومت میں اسمبلی کی وہ رٹ بحال ہوئی ہے اس وجہ سے متفقہ طور پر بلدیاتی نظام میں ترامیم کا بل اسمبلی میں لایا گیا ہے جس پر اسمبلی مبارکباد کی مستحق ہے۔

صوبائی وزیر قانون ایاز سومرو نے کہا کہ موجودہ حکومت شفاف انتخابات کرائے گی اس لئے ناظمین کو ہٹا کر ایڈمنسٹریٹرز مقرر کئے جا رہے ہیں کیونکہ ناظمین کے ہوتے ہوئے بلدیاتی انتخابات شفاف نہیں ہو سکتے تھے۔ انہوں نے کہا کہ بلدیاتی انتخابات 120 دن کے اندر ہوں گے اور جماعتی بنیادوں پر انتخابات کرائے جائیں گے جس میں آزاد امیدوار بھی حصہ لے سکیں گے۔ انہوں نے کہاکہ اس نظام میں اتحادیوں کے ساتھ مل کر بہتر ترامیم کی جائیں گی جو سندھ کے عوام کے مفاد میں ہوں گی۔ بل پر بحث کے بعد مذکورہ بل کو متفقہ طور پر منظور کر لیا گیا۔ مسلم لیگ (ق) کے شہریار مہر نے کہا کہ سندھ کے وسیع تر مفاد میں اس بل کی حمایت کرتے ہیں مگر سندھ حکومت نے مسلم لیگ (ق) سے بل کے متعلق کوئی مشورہ نہیں کیا اور سندھ حکومت کی مفاہمتی پالیسی برائے نام ہے اور مخصوص لوگوںکے ساتھ مفاہمت کی جا رہی ہے اس لئے سندھ حکومت اپنے وعدوں پر عمل کرے اور مفاہمتی عمل کو سب کے ساتھ عملی طور پر چلایا جائے۔ انہوں نے کہاکہ بل پر مشورہ نہ کئے جانے کے بعد بھی سندھ کے مفادات کے مطابق بل کی حمایت کرتے ہیں۔

این پی پی کے رکن مسرور جتوئی نے کہا کہ اس بل کی حمایت کرتے ہیں اور آج اس ایوان نے یہ ثابت کر دیا ہے کہ جمہوریت کامیاب ہے۔ متحدہ قومی موومنٹ کے رکن ڈاکٹر صغیر احمد نے کہا کہ 2001ءکے بلدیاتی نظام کو بھی بلدیاتی انتخابات میں مدنظر رکھا جائے اور ترامیم میں 2001ءکے بلدیاتی نظام کو مدنظر رکھ کر بھی ترامیم کی جائے۔ انہوں نے کہا کہ مفاہمتی پالیسی کی وجہ سے یہ بل ایوان میں لایا گیا ہے جس کی حمایت کرتے ہیں۔ سندھ اسمبلی میں قائد حزب اختلاف جام مدد علی نے کہا کہ اس بل کی حمایت کرتے ہیں۔ انہوں نے کہا کہ انتخابات شفاف ہونے چاہئیں اور اس نظام میں وہ ترامیم کی جائیں جو سندھ کے بہتر مفاد میں ہوں۔
کھوڑو کی جانب سے ارکان کو مبارکباد پیش کی گئی۔ بعد ازاں اجلاس منگل کی صبح 10 بجے تک ملتوی کردیا گیا۔

KARACHI: The Sindh Assembly is set to hold its session today while, for seeking the legislation over the Local Government (LG) system the new (LG) amended bill will be tabled in house today, Geo news reported.Sindh Minister for Local Bodies Agha Siraj Durrani is likely to present the proposed local government amended bill in Sindh Assembly.Durrani told media on Sunday that the bill has been submitted to the assembly secretariat and it would be presented in the house on Monday.Terming it a historic bill, Durrani said that this would bring an end to the system that miserably failed to provide relief to the poor people of the province, particularly interior Sindh.He said that the copy of the bill has been provided to all the MPAs, adding, the bill would ask the house that since the present local government system has completed its tenure the permission to appoint administrators be allowed as the Sindh government intends to hold fair and free elections.Durrani said that once the bill was passed by the house and assented by the Sindh governor, the nazims would be relieved from their offices all over Sindh, including Karachi.He said that the governor would be requested to sign the bill within 24 hours. The minister said that after the dissolution of City Council it would be decided with consensus as to what system should be adopted in Sindh.After the induction of administrators the Sindh government would request the Election Commission of Pakistan to give election schedule, he added.Durrani said that the present system was the brainchild of a dictator and it has been rejected by the three provinces and Sindh will decide which system to bring in after the present City Council was dissolved.This bill would be presented in the house after a hectic exercise, as top leadership of both the PPP and MQM had to intervene and it appeared at one stage that the coalition would break apart.Earlier, Muttahdia had reservations over the appointment of administrators, according to Local Bodies Minister Agha Siraj Durrani. However, after negotiations and dialogues Muttahida agreed on appointing administrators.Speaking at an event in Hyderabad, Dr Farooq Sattar said that MQM would participate in local bodies elections all over the country.There had also been a lot of controversy between City Nazim Syed Mustafa Kamal, provincial minister for local bodies and chief minister but later differences were resolved after Interior Minister Rehman Malik and Sindh Governor intervened to rescue the coalition.Meanwhile, political pundits claim that local government amended bill might be deferred once again in Sindh Assembly on Monday owing to the recent controversy between the government and the judiciary.This bill has been deferred in the house for dozen of times and if it is deferred again on Monday it will go in pending.The political analysts say that Muttahdia would not feel easy once they sign the bill, adding, the prevailing situation was highly volatile to present the bill.The top priority of PPP these days would be to keep close watch on the development of judiciary issues in Islamabad.The parliamentary leader of PPP Pir Mazharul Haq is in Dadu, while provincial minister for local bodies is also in interior Sindh.Speaking at an event in Hyderabad, Sindh chief minister said that during a core committee meeting late Sunday night a consensus would be developed with Muttahida following which the bill would be presented in the house.

KARACHI: Governor Sindh Dr. Israt-ul-Ebad and Chief Minister Syed Qiam Ali Shah met here at Governor House on Sunday, Geo news reported. According to sources, two leaders discussed the overall law and order situation in Sindh province during meeting. The meeting also reviewed the ties of political parties included in Sindh coalition government, sources said. As per declaration issued from Governor Sindh following the conclusion of meeting, all coalition partners in Sindh government are agreed upon carrying out joint efforts for the development and welfare of the people in Sindh province. During the meeting, two leaders also vowed to continue coalition government and resolve all standing conflicts through consultation and cooperation at every level. Also, it was decided that the solutions of the conflicts among Sindh coalition partners, which were reached through dialogue, will be put into practice in letter and spirit.

KARACHI: Lawyers bodies, civil society and various political parties staged countrywide demonstrations on Sunday in support of superior judiciary after it struck down two presidential orders about the appointment of judges on Saturday evening. The Jamaat-e-Islami held a protest demo in front of Karachi Press Club against the government. The protestors were holding placards inscribed with pro-judiciary slogans. The protest was led by JI leader Muhammad Hussain Mehanti. Similarly, the JI also staged protest outside the Lahore Press Club, while the Tehrik-e-Insaaf took out a rally. Addressing the participants, speakers said that they would not hesitate to take to streets again for the cause of judiciary's independence. A rally was taken out in Multan in support of judges. The participants of the rally chanted slogans in favour of Chief Justice Iftikhar Muhammad Chaudhry, Lahore High Court Chief Justice Khwaja Sharif and senior judge Justice Saqib Nisar. They said that President Zardari had adopted the dictatorial approach under a democratic set-up. In Quetta, Pakistan Tehrik-e-Insaaf workers staged a demonstration in front of Press Club.

ISLAMABAD: Pakistan Muslim League (PML-N) will not allow the government to move scot-free, the party chief Mian Nawaz Sharif warned terming President Asif Ali Zardari as the biggest danger to the democracy. Addressing the packed hall of journalists after the party meeting, he said it seemed that the government does not accept the restored judiciary. The democracy never before faced such a great threat as now in the form of President Zardari, who has become the gravest danger to democracy, he said. The PML-N condemns the incident that occurred yesterday, as the event plunged the country in the uncertainty and the President House outgrew its limits, Sharif told. He said yesterday incident was an action re-play of November 3, 2007, adding the government is targeting the judiciary to safeguard its corruption in preference for their corruption to the respect for the judiciary. The Army should have the role stipulated in the Constitution, he said. Nawaz Sharif said he forcefully warned the government to ensure the supremacy of the Constitution, adding his party categorically rejects the autocratic method adopted by the government. He said the judiciary was resorted by the people not the government which only issued a notification, informing the journalists that he had told Prime Minister Syed Yousuf Raza Gilani a day before not to delay the implementation on the recommendations of judges appointments. However, the following day, something else surfaced, he added demanding the recommendations of the Chief Justice of Pakistan Justice Iftikhar Muhammed Chaudhry should be immediately put into action. Nawaz said the PML-N wants to make it abundantly clear to the government in unequivocal terms that it would not be allowed to go its way on judges appointments nor would it be spared the chance for corruption. We can make harsh decisions in the coming days and will protest in and outside the Parliament and mobilize the masses. We will not allow anyone to spoil the institutions for personal motives, he said. Had the Charter of Democracy been implemented, then there would not have been these problems, he asserted demanding President Zardari to bring back to Pakistan his wealth siphoned off to Swiss accounts; this is the money hard-earned by the people of Pakistan. The country has been turned into a circus, he added. The people of Pakistan will take care of all affairs, the Army should not be dragged into them; nor should the Army get itself involved in such affairs
